By accessing or using The Conduct Management System including our website, mobile application, and related services, you agree to comply with and be bound by these Terms and Conditions. If you do not agree, please do not use our services.
Description of Service
TCMS provides a digital platform for Applied Behavior Analysis (ABA) professionals, technicians, and stakeholders to collect, track, and analyze behavioral data. TCMS is a tool to assist professionals; it does not replace professional medical, psychological, or behavioral advice, diagnosis, or treatment.
User Accounts & Responsibilities
- Eligibility: You must be legally authorized to collect and manage behavioral data in your jurisdiction.
- Account Security: You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized access to your account.
- Accuracy of Data: You are solely responsible for the accuracy, quality, and legality of the data you enter into TCMS.
Data Privacy and Compliance (HIPAA/FERPA)
Users are responsible for ensuring that their use of TCMS complies with applicable privacy laws, including the Health Insurance Portability and Accountability Act (HIPAA) and the Family Educational Rights and Privacy Act (FERPA). We implement industry-standard security measures, but you must not share login information or leave sessions unattended in environments where unauthorized individuals may access Protected Health Information (PHI).
Intellectual Property
All software, design, text, and graphics related to TCMS are owned by The Conduct Management System. You may not copy, reverse-engineer, or distribute our platform without prior written consent. The behavioral data you input remains your property or the property of your organization.
Limitation of Liability
To the maximum extent permitted by law, TCMS shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our services, including data loss or unauthorized access to your transmissions.
Termination
We reserve the right to suspend or terminate your access to TCMS at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
